Terms of Service

1. Acceptance of these Terms

Raw Edit AI (the “Service”) is operated by Stratum S.R.L., a limited liability company organised under the laws of the Republic of Moldova, registered under fiscal code 1026023045265, with its registered office at str. Alexandr Pușkin 49, ap.(of.) 67, MD-2005, Chișinău, Republic of Moldova (“Stratum”, “we”, “us” or “our”). By creating an account, accessing or using the Service, you agree to be bound by these Terms of Service (the “Terms”) and by our Privacy Policy. If you do not agree, you must not use the Service.

The Service relies on third-party providers. By accepting these Terms you also acknowledge and accept (a) the terms and privacy policy of our authentication provider, Clerk, (b) the policies of our inference provider, AtlasCloud AI (see Section 8 below for the full list of AtlasCloud documents), and (c) the policies of our payment processor, Paynet.

2. Eligibility and age restriction

The Service is intended exclusively for adults. You must be at least 18 years old, or older if the age of majority in your jurisdiction is higher, to create an account or use the Service. By using the Service you represent and warrant that you meet this requirement. We reserve the right to terminate any account we reasonably believe to belong to a minor and to delete the associated data, subject to any applicable legal-hold obligations.

You must not use the Service in any jurisdiction where doing so is unlawful, or where you are otherwise prohibited from using it.

3. Description of the Service

Raw Edit AI provides an AI-assisted image editing and generation interface. When you submit a prompt and one or more input images, the Service forwards your prompt and images to AtlasCloud AI, which runs the inference using various AI models. The resulting output is returned to you through the Service. We do not operate the underlying machine-learning model and cannot guarantee any specific result.

4. Account and authentication

Accounts are created and managed through Clerk. Authentication, password storage, multi-factor verification and session management are performed by Clerk under Clerk’s own terms and privacy policy. You are responsible for safeguarding your credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorised access. Each individual may hold only one account.

5. Acceptable use and prohibited content

You agree not to use the Service, and not to upload, generate, store, transmit or distribute through the Service, any content or activity that is prohibited below. The following list is illustrative and not exhaustive:

• Child sexual abuse material (CSAM) and any content that sexualises or exploits minors, in whole or in part, real or fictional, in any form whatsoever.
• Adult, sexual, pornographic, erotic or otherwise sexually explicit content, of any kind, depicting any subject (real, fictional or AI-generated).
• Deepfakes, face-swaps, voice clones or any non-consensual depiction of an identifiable real person, including in a sexual, harmful, defamatory, deceptive or embarrassing context.
• Content that harasses, threatens, defames, doxes, stalks or otherwise harms another person; content that incites violence, terrorism, self-harm or hatred against any group; content that promotes, facilitates or instructs in criminal activity.
• Any content or use that is unlawful under the laws of the Republic of Moldova or under any laws applicable to you, including intellectual-property infringement, fraud, sanctions violations and misuse of personal data.
• Reverse engineering, decompiling, scraping, automated abuse, attempts to bypass rate limits or quotas, attempts to jailbreak the model or extract weights, attempts to disrupt the Service or other users, and any use of the Service to develop a competing product.

You are solely responsible for the inputs you submit and for the outputs you generate, store, share or further distribute. You warrant that you hold all necessary rights, licences and consents for any material you upload, and that your use of the Service does not violate the rights of any third party.

6. Cooperation with law enforcement

We will actively cooperate with the Prosecutor’s Office of the Republic of Moldova, the Ministry of Internal Affairs of the Republic of Moldova, Moldovan courts and any other competent Moldovan authority, as well as with foreign authorities operating through lawful channels such as mutual legal assistance treaties or Interpol. Where required or permitted by law, we may preserve and disclose user data — including account information, prompts, generation metadata, timestamps, IP addresses and transaction history — in response to a lawful request, court order or to prevent imminent harm.

7. User content and licence

You retain ownership of the images, prompts and other materials you upload to the Service (your “Inputs”), and, to the extent allowed by applicable law, of the materials produced by the Service in response to your Inputs (your “Outputs”). AI-generated material may not be eligible for copyright protection in some jurisdictions; we make no representation that any Output is protectable or that it does not resemble third-party material.

You grant Stratum a worldwide, royalty-free, non-exclusive, sublicensable licence to host, store, transmit, copy, display, and forward your Inputs and Outputs solely to the extent necessary to provide, secure and improve the Service, to forward them to our inference provider (AtlasCloud AI), and to comply with our legal obligations. This licence ends when we delete the relevant materials in accordance with Section 11 and our Privacy Policy.

8. Third-party services

The Service depends on the following third-party providers. By using the Service, you acknowledge that your data will be transmitted to and processed by these providers, and you accept their respective terms and privacy policies in addition to ours:

• AtlasCloud AI — inference provider. Your prompts and uploaded images are transmitted to AtlasCloud to fulfil your generation request. You are also bound by the following AtlasCloud documents: Privacy, Acceptable Use, Data Deletion Policy and Data Retention. Although we delete your input images and generated outputs from our own systems within one hour of generation, AtlasCloud may retain content for longer periods under its own policies. Such retention is outside our control.
• Clerk — authentication and account management (clerk.com/legal).
• Paynet — payment processor (paynet.md). All sensitive payment data, including card and bank-account details, is processed exclusively by Paynet. Stratum does not collect, see or store such data.
• Cloudflare — hosting, object storage, database, image transformation and content delivery.

9. Credits, pricing and payments

The Service is paid for through prepaid credits. Each generation consumes a number of credits as displayed in the application at the time of submission. The pricing and credit packs shown in the application are authoritative; we may change pricing, the cost of a generation or the contents of a credit pack at any time with reasonable prior notice. All payments are processed by Paynet (including Visa, Mastercard payments) and are denominated in the currency displayed at checkout.

10. Refund policy

Unused credits are refundable upon written request. To request a refund of unused credits, write to support@rawedit.ai from the email address associated with your account, including the approximate date of purchase so we can locate the transaction.

Used credits are non-refundable, because they correspond to AI inference that we have already paid for to our inference provider. This does not affect any statutory consumer rights that apply to you (including, where applicable, the 14-day right of withdrawal for distance contracts concluded with consumers in the European Union, to the extent that right applies and has not lapsed).

11. Content retention

Input images and generated outputs are automatically deleted from our systems within one hour of generation. Prompts, job metadata, timestamps and other generation records are retained for an indefinite period for the purposes of fraud prevention, abuse investigation, security, legal-hold compliance, and our tax and accounting obligations under Moldovan law. Full retention details are set out in our Privacy Policy.

12. Suspension and termination

We may suspend or terminate your access to the Service, in whole or in part, immediately and without prior notice, if we reasonably believe that you have breached these Terms (in particular Section 5), if your activity is unlawful, if your activity poses a risk to us, to other users or to third parties, or if we are required to do so by law. You may close your account at any time. Closure does not entitle you to a refund of used credits.

13. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, to the maximum extent permitted by Moldovan law. We do not warrant that the Service will be uninterrupted, error-free, secure or that any specific result will be achieved. Outputs are generated by an artificial-intelligence model and may be inaccurate, biased, offensive, unsuitable for your purpose, or resemble existing third-party material. You are responsible for evaluating any Output before relying on it, sharing it or making it public.

14. Limitation of liability

To the maximum extent permitted by Moldovan law, Stratum’s total aggregate liability arising out of or relating to these Terms or your use of the Service shall not exceed the greater of (i) the total amounts you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (ii) one hundred euro (EUR 100). We shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, even if advised of the possibility of such damages.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under Moldovan law, including liability for gross negligence, wilful misconduct, death or personal injury caused by our negligence, or mandatory statutory consumer rights.

15. Indemnification

You agree to defend, indemnify and hold harmless Stratum and its directors, employees and contractors against any claims, damages, liabilities, losses, costs and expenses (including reasonable attorneys’ fees) arising out of or in connection with (a) your Inputs or Outputs, (b) your breach of these Terms, (c) your unlawful use of the Service, or (d) your violation of any third-party right.

16. Governing law

These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by, and shall be construed in accordance with, the laws of the Republic of Moldova, without regard to its conflict-of-laws rules.

17. Jurisdiction and dispute resolution

The competent courts of Chișinău, Republic of Moldova, shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service. Where you use the Service as a consumer, mandatory consumer-protection rules of the country of your habitual residence may grant you the right to bring proceedings before the courts of that country; nothing in these Terms removes any such mandatory right.

18. Changes to these Terms

We may amend these Terms from time to time. Material changes will be notified to you at least thirty (30) days in advance, by email or through an in-product notice. Non-material changes take effect when they are published on this page. Your continued use of the Service after the effective date of any change constitutes your acceptance of the amended Terms. If you do not accept the changes, you must stop using the Service.

19. Severability and entire agreement

If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or struck out if no such modification is possible, and the remaining provisions shall continue in full force. These Terms, together with our Privacy Policy and any policies referenced herein, constitute the entire agreement between you and Stratum regarding the Service and supersede any prior agreements between us on that subject.
